Corps Publishes Final Rule on Disaster Assistance

[Excerpts from Apr. 21 Federal Register Notice]
The U.S. Army Corps of Engineers is promulgating a final rule to revise 33 CFR part 203, ["Emergency Employment of Army and Other Resources, Natural Disaster Procedures."] Today's final rule completes the rulemaking process initiated on 26 February 2002 with publication of the proposed rule to revise 33 CFR part 203, which implements Public Law 84-99.

WRDA 96 additions include the option to provide nonstructural alternatives in lieu of structural repairs to levees damaged by flood events, and the provision of a levee owner's manual. Other significant changes include expansion of investigation ability for potential Advance Measures work, and a streamlined approach for requests for assistance from Native American tribes and Alaska
Native Corporations. This rule is effective May 21, 2003.

Over ninety percent of the commenters [on the proposed rule] addressed the proposal to change the cost share provisions for rehabilitation of damaged flood control works, both Federal and non-Federal. The Corps will maintain the status quo for cost sharing rehabilitation of damaged flood control works. Therefore, rehabilitation of Federal flood control works will remain at 100 percent Federal cost, and rehabilitation of non-Federal flood control works will remain at 80 percent Federal cost and 20% local cost.
