Winnipeg Charged Under Fisheries Act For Sewage Spill

[May 27 Environment Canada News Release]
Environment Canada has charged the City of Winnipeg with one count of violating subsection 36 (3) of the Fisheries Act following an investigation into the September 2002 sewage spill into the Red River.

Subsection 36 (3) of the Fisheries Act protects fish-bearing waters from the deposit of any substance that is deleterious to fish and aquatic life.

The first appearance in Provincial Court has been scheduled for June 30, 2003.

First offences under subsection 36 (3) of the Fisheries Act are punishable on summary conviction by a fine of up to $300,000, and for subsequent offences a fine of up to $300,000 or six months imprisonment, or both.
